3 Magazine Ontario Subscription Contest Official Rules

  1. Contest Overview
    • The “3 Magazine Subscription Contest” (the “Contest”) is sponsored by 3 Magazine, a division of 369 Publishing Inc. (the “Sponsor”).
  2. Eligibility
    • Who Can Enter: The Contest is open only to legal residents of Ontario, Canada, who are 18 years of age or older at the time of entry.
    • Who Cannot Enter: Employees, representatives, and agents of the Sponsor, its parent company, subsidiaries, affiliates, advertising and promotion agencies, any entity involved in the development, production, administration, or fulfilment of the Contest (collectively, the “Contest Parties”), and their immediate family members (spouse, parent, child, sibling, and their respective spouses) and household members are not eligible to participate.
    • Agreement to Rules: By participating, entrants agree to be fully and unconditionally bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Contest.
  3. Contest Period
    • The Contest begins on November 13, 2024 at 12:00 PM Eastern Standard Time (EST) and ends on November 28, 2024 at 11:59 PM EST (the “Contest Period”). All entries must be received within the Contest Period to be eligible.
  4. How to Enter
    • For Current Subscribers:
      • Visit the Contest entry page at https://contest.threemagazine.com/.
      • Complete the official entry form using the same email address associated with your 3 Magazine annual subscription.
      • Complete the mandatory survey. Survey responses must be genuine and provided in good faith without any intent to subvert, mask, or manipulate the responses or the process.
    • For New Subscribers:
      • Subscribe to 3 Magazine’s annual paid subscription during the Contest Period at http://www.threemagazine.com/passport-series
      • Ensure the same email address that was used for the annual magazine subscription is used in the Contest entry form.
      • Visit the Contest entry page and complete the entry form, including the survey. Survey responses must be genuine and provided in good faith without any intent to subvert, mask, or manipulate the responses or the process.
    • No Purchase Necessary Entry:
      • To enter without paying for the annual subscription, please complete the following:
        • Mail in a 3”x 5” card with your full name, complete mailing address, telephone number, and email address to the address listed below.
        • Include a printed and completed copy of the survey available on the Contest entry page. Survey responses must be genuine and provided in good faith without any intent to subvert, mask, or manipulate the responses or the process.
        • Ensure the same email address listed on your entry card is the same one used for the newsletter subscription. Your entry will be disqualified if the email addresses do not match.
        • Mail both in a sealed envelope with sufficient postage to: 100 Westney Rd. South, Ajax, Ontario L1S 7H3 Attn: Contest Entry
        • Mail-in entries must be postmarked during the Contest Period and received by November 28, 2024.
    • Entry Limit:
      • Limit of one (1) entry per person/email address, regardless of the method of entry.
      • Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, or any other methods will void that entrant’s entries, and they may be disqualified.
    • Prohibited Methods:
      • Any use of robotic, automatic, programmed, or similar entry methods is prohibited.
      • Entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the Official Rules may be disqualified.
  5. Data Usage and Privacy
    • Use of Personal Information:
      • By entering the Contest, entrants consent to the collection, use, and disclosure of their personal information by the Sponsor for the purposes of administering the Contest, creating a subscriber profile, subscription to the newsletter, and providing content, contests, and information aligned with their interests and requirements.
    • Anti-Spam Compliance:
      • The Sponsor complies with Canada’s Anti-Spam Legislation (CASL). Entrants may unsubscribe from communications at any time without affecting their Contest entry.
    • Privacy Policy:
      • Personal information will be handled in accordance with the Sponsor’s privacy policy, available at https://threemagazine.com/privacy-policy/.
  6. Prize
    • Grand Prize: Six (6) Grand Prizes are available. Each Grand Prize consists of:
      • Round-trip economy airfare for the winner departing from Pearson International Airport in Toronto, Ontario, to Anguilla.
      • Three (3) nights’ standard hotel accommodation (one room) at a hotel selected by the Sponsor.
      • One (1) dinner organised by 3 Magazine.
    • Approximate Retail Value: The total approximate retail value of the Grand Prize is $10,000 CAD.
    • Prize Conditions:
      • The prize must be accepted as awarded, without substitution, transfer, or assignment, except at the Sponsor’s sole discretion.
      • The Sponsor reserves the right to substitute the prize or any component with one of equal or greater value.
      • All travel arrangements will be made by the Sponsor or its agents.
      • Travel must be taken on dates specified by the Sponsor or the prize will be forfeited.
      • The winner and their companion are responsible for obtaining all necessary travel documentation, including valid passports and any required visas.
      • Both the winner and their companion must agree to and comply with all the terms and conditions of the Contest.
      • The companion must be 18 years of age or older and will be required to sign a Declaration of Eligibility and Liability/Publicity Release and a Worldwide Media Release.
    • Expenses Not Included:
      • The winners and their companions are responsible for all expenses not expressly stated in these Official Rules, including but not limited to:
        • Travel insurance.
        • Baggage fees.
        • Ground transportation not specified.
        • Meals and beverages (other than the one dinner).
        • Incidental expenses.
        • Personal expenses.
        • Activities and excursions not specified.
      • The winners are responsible for reporting the prize value to tax authorities and paying any applicable taxes.
  7. Winner Selection and Notification
    • Method and Selection Date of Winner:
      • A winner will be selected on each of the following dates: the 16th, 18th, 20th, 22nd, 25th, and 27th. Winners will be chosen based on their survey responses, using criteria determined by the Sponsor, with selection made at the Sponsor’s discretion. The Sponsor reserves the right to adjust the dates of winner selection as needed. The selection process will be conducted at the Sponsor’s offices or a designated location, from all eligible entries received.
      • Selection will be based on the responses provided in the entrant’s survey or application, with criteria determined at the Sponsor’s discretion. The Sponsor will review entries and select those that best align with the themes, values, or goals of 3 Magazine as outlined in the contest.
      • The Sponsor reserves the right to adjust the dates of winner selection if necessary. In cases where a selected winner is unable to accept the prize or is deemed ineligible, an alternate winner will be chosen based on the same criteria. All decisions made by the Sponsor regarding winner selection are final.
      • In the event that a selected winner is unwilling or unable to accept the prize, does not meet the eligibility requirements, or fails to comply with the contest rules, the Sponsor reserves the right to select an alternate winner. The alternate winner will be chosen from the remaining eligible entries based on the same criteria and at the Sponsor’s discretion, as outlined in the selection process. The alternate winner will be notified following the same procedure as the original winner, and must meet all eligibility requirements and comply with the contest rules to claim the prize.
      • The Sponsor reserves the right to repeat this process as needed until the prize is successfully awarded.
    • Notification:
      • The selected entrant will be notified via email or telephone (using the contact information provided at the time of entry) within 24 hours of selection.
    • Requirements to Claim Prize:
      • To be declared a winner, each selected entrant must complete the following within 24 hours of being notified:
        • Respond to the notification within twenty-four (24) hours accepting the prize.
        • Correctly answer, unaided, a time-limited mathematical skill-testing question administered by the Sponsor.
        • Complete, sign, and return a Declaration of Eligibility and Liability/Publicity Release (“Release Form”), the Contest Rules (this document), within the time specified in the notification.
        • Complete and sign a Worldwide Media Release permitting the Sponsor to use their names, likenesses, and any recorded media from the prize experience.
    • Disqualification:
      • If the selected entrant:
        • Cannot be contacted within 24 hours.
        • Fails to correctly answer the skill-testing question.
        • Fails to return the required documents within the specified time.
        • Is found to be ineligible or in violation of these Official Rules.
      • Then they will forfeit the prize, and an alternate entrant may be selected at the Sponsor’s sole discretion.
  8. Skill-Testing Question
    • In compliance with Canadian law, the selected entrant must correctly answer, without assistance, a mathematical skill-testing question, which will include at least three separate mathematical functions, not use the numbers 0 or 1, and include at least two double-digit numbers (e.g., (20 x 4) – (12 ÷ 3) = ___).
  9. General Conditions
    • Conduct:
      • By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor.
      • The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be:
        • Tampering with the entry process or the operation of the Contest.
        • Acting in violation of these Official Rules.
        • Acting in an unsportsmanlike or disruptive manner.
    • Modification or Termination:
      • The Sponsor reserves the right to cancel, suspend, or modify the Contest if any fraud, technical failures, or any other factor beyond the Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest.
      • The Sponsor reserves the right to modify, suspend, or terminate the contest at any time, for any reason, without prior notice. This includes, but is not limited to, circumstances where unforeseen technical issues, fraud, or any factors beyond the Sponsor’s reasonable control compromise the fairness, integrity, or intended conduct of the contest.
      • In the event of modification, suspension, or termination, the Sponsor may, at its sole discretion, choose to proceed with the contest in a manner that preserves its original intent or to cancel the contest entirely, without awarding any remaining prizes.
    • Force Majeure:
      • The Sponsor shall not be liable for any failure to perform its obligations where such failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, pandemic, government restrictions, natural disasters, or any other event of force majeure.
      • In the event the trip is canceled due to unforeseen circumstances, the Sponsor is not obligated to reschedule the trip or provide any compensation to the winners.
  10. Release and Indemnification
    • Release:
      • In exchange for the opportunity to participate in the prize experience, I hereby absolve, release, and forever discharge the Sponsor, along with its parent entities, subsidiaries, affiliates, and their respective advertising and promotional agencies, St. Joseph Communications, the Contest winner, and all of their respective officers, directors, employees, agents, and representatives (hereinafter collectively referred to as the “Released Parties”) from any and all claims, liabilities, demands, actions, or causes of action, whether known or unknown, anticipated or unanticipated, that I have or may have arising out of or in any way connected with:
      • My engagement in any aspect of the prize experience.
      • Any activities, travel, or other occurrences directly or indirectly related to the prize experience.
      • This release extends to any and all claims I have or may have against the Released Parties, including but not limited to claims of negligence, personal injury, death, or property damage.
    • Indemnification:
      • The winners must sign the Release Forms to:
        • Confirm compliance with the Official Rules.
        • Agree to accept the prize as awarded.
        • Release the Released Parties from any liability.
        • Indemnify the Released Parties against any loss, damage, or expense arising from their breach of the Official Rules or the use or misuse of the prize.
      • Travel Risks:
        • The winners and their companions acknowledge that travel involves inherent risks, including illness, personal injury, property damage, or death, and assume all such risks.
        • The Released Parties shall not be responsible for any delays, cancellations, or other problems related to travel arising from causes outside of their reasonable control.
  11. Dispute Resolution and Arbitration
    • Any disputes arising out of or connected with this Contest will be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the Ontario Arbitration Act, 1991.
    • The arbitration will be conducted in Toronto, Ontario, in English, and the arbitrator’s decision shall be enforceable in any court of competent jurisdiction.
    • Entrants agree that the laws of Ontario and the federal laws of Canada applicable therein shall govern this Contest.
  12. Limitation of Liability
    • Technical Issues:
      • The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, or failure of any email or entry to be received by the Sponsor.
    • Damages:
      • Under no circumstances shall the Sponsor be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of participation in the Contest or receipt or use of the prize.
  13. Tax Implications
    • The winner is solely responsible for reporting the prize to relevant tax authorities and paying any applicable taxes, duties, or fees associated with the prize.
    • The Sponsor will not provide any tax advice or statements regarding tax implications.
  14. Accessibility and Inclusivity
    • The Sponsor is committed to accessibility and inclusivity. Entrants requiring accommodation to participate in the Contest should contact the Sponsor at social@369global.com to discuss their needs.
  15. Publicity
    • By accepting the prize, the winner consents to the use of their name, city/province of residence, voice, statements, photographs, and likeness for advertising and promotional purposes in any media, worldwide, without further compensation, unless prohibited by law.
  16. Media Release
    • The winner must sign a Worldwide Media Release allowing the Sponsor to photograph, film, record, audiotape, or videotape the winner during the prize experience.
    • The Sponsor may use, reproduce, publish, display, broadcast, distribute, and create derivative works of such media in any and all media now known or hereafter devised, in perpetuity, without further compensation to the winner.
  17. Governing Law
    • The Contest is subject to all applicable federal, provincial, and municipal laws and regulations.
    • Any disputes arising from the Contest will be adjudicated in the courts of Ontario, and entrants consent to the jurisdiction and venue of such courts.
  18. Rule Amendments
    • The Sponsor reserves the right to amend or terminate these Official Rules at any time without prior notice, subject to applicable laws.
  19. Severability
    • If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of the Official Rules, which will remain in full force and effect.
  20. Entire Agreement
    • These Official Rules constitute the entire agreement between the entrant and the Sponsor with respect to the Contest and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written.
